Tree of Hope is a paid, private service from Tribe Giving LLC, a for-profit company. It is not a charity and is not affiliated with any hospital, foundation or charity. Money a business pays is never handed to the family; what the family receives is the year of people, and anything a business sends itself, like the flowers.
Terms
A seat, a root, and the lines that govern both. The honest line is the first thing in them.
Version 1, October 2026. Under review by counsel; the bracketed items close when counsel confirms them. Plain English on purpose: the people reading this are a neighbour, a florist and a caregiver, in that order.
Who we are
Tribe Giving LLC, trading as Tree of Hope and VIVEKIND, a for-profit company (“we”, “us”, “the company”). Tree of Hope is a service of Tribe Giving LLC. vive. is the house it lives in.
What the money pays for: the year of organising, the software the family uses, and the people at the company who keep every tree running. The friends who show up are never paid, and the family is never paid.
What the service is
A paid, private membership service: for twelve months from the day a seat opens, a closed circle of people who know one family, hosted by a room, organised by software (Kim), with paid local help by the hour where the circle cannot cover. The product is called ViveTree on your statement and receipt; the service that writes to businesses is Kindness in Motion. Both are the same company.
What it is not: not medical care, nursing, therapy or advice of any kind. Not a hospital programme. Not insurance. Not a home-care agency. Not a way to send money to a family. Nothing in the service is a substitute for a doctor, a nurse or emergency services. In an emergency, call 911.
Kim is software, not a person. Kim organises; people do the showing up. Every message from Kim says it is from Kim. Nothing Kim writes is medical advice.
Who these terms bind
The person who takes a seat (Part A) and the business that takes a root (Part B). The patient and the caregiver are the people the service is for. They are never parties to these terms, never pay, are never counted, and never owe us anything.
You must be 18 or over. The service is offered in the United States only, for now.
Part A. A seat
A1. What a seat is
A seat is one person who knows the family, inside one tree, for twelve months. Paying is what makes a seat a seat: it is a promise to show up, with a date on it. A seat is for the person who takes it and cannot be transferred.
A2. Price and term
You choose what a day is worth: $1, $2.50, $5. Billed monthly ($33, $75, $150 a month, for twelve months), or once for the twelve months ($365, $912.50, $1,825, paid in advance). The seat is the same at every price. The term runs for twelve months from the date your seat opens, or from the date the tree is given, whichever is later. Prices are in US dollars and include any tax we must collect How sales tax applies to a seat will be confirmed before launch..
A3. Who never pays
The patient and the caregiver pay nothing, now or later, in any form. There is no price, no plan and no checkout for them, and we will not accept payment from them.
A4. Held seats
Five seats in every tree are held: paid for by the underwriting (the roots and the company’s own credit), named by the connectors, and charged nothing to the person who sits in them. Nobody inside is told which seats are held, and we will not tell them.
A5. The hardship pause
You may pause your seat from inside the tree at any time. Nobody asks why. On a monthly seat, a pause stops the next charge until you switch it off. On a seat paid once, how a pause affects the term will be confirmed before launch. Your seat stays open while paused; your leaves stay on the tree.
A6. No refunds once a tree is given
Once a tree is given to a family, there is no refund of a seat, except where the law requires one. The gift is the circle, and the circle is already there. If a tree does not open on its date, a seat is never charged. You may leave a tree at any time from inside it: your seat closes at the end of the period you paid for, nothing you added is removed, your name comes off the circle, and nobody inside is told why. A monthly seat stops at the next renewal date.
A7. Renewal
A monthly seat renews each month for the twelve-month term and then ends. A yearly seat does not renew by itself. When the tree closes at the end of its twelve months, a new tree opens only if the family and the room choose it, and a seat in it must be chosen again. We will tell you the date; we will not charge you for a new year unless you take a seat in it. How state rules on automatic renewal apply will be confirmed before launch.
A8. The inside is private
What is inside a tree is private to the family and the circle. It is not public, not for sale, and not ours. You agree to keep what you see inside a tree inside it.
A9. What a seat is not
A seat does not make you a carer, a nurse, an employee or an agent of the company. You decide what you offer and when. The company does not direct your care and is not responsible for it. Paid local help is paid by the tree and is not nursing.
A10. Consent
A tree is started where a family has already asked for help in public, and is private until one of the connectors shares it. Nothing about a family appears on an outside page, ever. The family may close a tree at any time.
A11. If the worst happens
The tree goes quiet. The calendar closes, Kim stops proposing, and the circle is told what the family chose to say, and nothing else. All seat charges pause at once. The family’s wishes govern what stays on the tree, what is exported and what is deleted. Nobody is asked again.
A12. Our side
For the term we will keep the tree running, keep the calendar, send the week note, pay the local help the tree uses, and hold the five seats. We do not promise that any particular person will show up, that any particular need will be met, or any outcome for the family.
Part B. A root
B1. What a root is
A root is one local business's annual commitment for Tree credits in its own ZIP, not one specific Tree. One business per category, per ZIP, per year. The category is exclusive to the root in its ZIP for its year. This is a purchase of a business service, recorded and invoiced as one.
B2. Price: the bands
One payment, in advance, with a fixed part and a monthly part. The monthly part is counted from the month of payment to December of the root’s year. Band A: $5,000 plus $1,000 a month. Band B: $3,500 plus $500 a month. Band C: $2,500 plus $350 a month. There are three bands and no others; we tell you yours in writing before you pay. A root that joins in November or December has the rest of this year included, and its year is the next one.
B3. What the money pays for
What the money pays for: the year of organising, the software the family uses, and the people at the company who keep every tree running. The friends who show up are never paid, and the family is never paid. None of the root’s money is handed to the family, the room, or anyone inside a tree.
B4. What the root receives
- The Root mark, “K” and the year (for example K 2026), for use from the date of payment (B5).
- The line “rooted here by” and the business’s name on the outside of each tree its credits go to in its ZIP, for its year.
- The year-end report in December: numbers, never names.
- The category, exclusive in its ZIP for its year.
B5. The Root mark licence
We grant the root a non-exclusive, non-transferable, royalty-free licence to display the Root mark with its year on its window, counter, website and printed matter, from the date of payment to 31 December of its year. How long the mark may stay up after that will be confirmed before launch. The mark must be reproduced from the files we supply, unaltered, with the year, and never joined to any other mark. The licence ends on non-payment, chargeback, misuse, or if the root says anything the mark does not say (B6). We may inspect use and ask for a correction.
B6. What the mark means, and what the root may not say
The Root mark means this business paid, in advance, for a year of Tree credits in its ZIP, before any of it had happened. The root may say it funded a year. The root may not say or imply that it gave, delivered or provided care; that it is affiliated with the family, the room, any hospital or any nonprofit; that any part of its payment reached the family; or that the payment was a gift. The root may not name the family or anyone inside the tree. The root may not use the words from the front door, the tree under glass, the vive. device or the emblem; it has the Root mark and the credit line only.
B7. “Underwritten by”
The company’s receipt, invoice, report and outside page describe the root’s payment as: “Underwritten by” and the business’s name, then “a year of Tree credits in its ZIP, paid in advance.” That is the only description of the payment the company will use, and the only one the root may quote.
B8. No access to the inside
The root receives no information about the family, no presence inside the tree, no message to the circle, no say in who sits or what is needed, and no thank-you unless the family chooses to send one. The outside page carries the root’s name; the family’s circle does not.
B9. What the root sends itself
Anything the root chooses to send the family (flowers, a meal) is the root’s own act, at its own cost, passed through the room so the family’s address is never shared. It is not part of this agreement, not invoiced, not required, and not credited against the price. The report may count it and never values it.
B10. Renewal is an offer on a date
The root’s year ends on 31 December. In the December report we will offer the root the same category in its ZIP for the next year, at the band then in writing. Nothing renews unless the root chooses it. No charge is made for a new year without a new written yes.
B11. If no tree opens, or a tree goes quiet
The payment stands whether or not a Tree opens in the ZIP that year. An unused credit rolls on in that ZIP, for the next family. If the worst happens during the year, a tree goes quiet; the root keeps the mark for its year and receives the report of what grew up to that point.
B12. No endorsement
The root’s payment is not an endorsement of the root by the company, the room or the family, and the credit line is not one. A room’s name on the outside page is the plain name of the tree and implies nothing about the room’s view of the root.
B13. Invoice and tax
The company issues an invoice and a receipt for a business service. We take no tax position; the document says only what it is. The root must not describe any part of the price as a gift.
Part C. General
C1. No affiliation
The room is a host, not a party, not paid, and never on an invoice.

The limits of our liability will be set out here before launch.
C3. Changes
We may change these terms for future terms. A change does not alter the price or the content of a seat or a root already paid for.
C4. Governing law
The governing law and venue for these terms, and how disputes are resolved, will be confirmed before launch. Consumer rights in your state that cannot be waived are not affected.
C5. Privacy
Our privacy notice is part of these terms. We keep your name and this address only, so that we can honour your answer, and nothing else.
